Pursuant to the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), this section serves as our "Notice at Collection." We collect the categories of personal information listed in Section 2 for the business purposes described in Section 3. We do not "sell" candidate personal information and we do not "share" it for cross-context behavioral advertising.
In the course of our talent acquisition activities, we collect "Personal Information" and "Sensitive Personal Information" as defined under U.S. law. This information is collected directly from you, through recruitment agencies, or from third-party professional networks.
We process candidate information for legitimate business purposes related to recruitment and workforce planning:
Yandaz may use automated tools to sort applications based on objective criteria (e.g., required certifications). However, in compliance with emerging U.S. regulations (such as NYC Local Law 144), any significant employment decision—including rejection—is subject to human review. We do not use AI for facial recognition or emotion analysis during video interviews.
Yandaz does not "sell" candidate personal information. We "share" or disclose information with the following categories of third parties for business purposes:
If you receive a conditional offer of employment, Yandaz will conduct a background check. This process is governed by the Fair Credit Reporting Act (FCRA). You will receive a separate "Background Check Disclosure and Authorization" form. If we intend to take "adverse action" (such as rescinding an offer) based on the results, we will provide you with a copy of the report and a summary of your rights before making a final decision.
If you require a reasonable accommodation to participate in the application or interview process (per the Americans with Disabilities Act - ADA), any medical or disability-related information provided will be treated as a confidential medical record. This information is stored separately from your general application file and is only accessible to HR and Legal personnel involved in the accommodation process.
Depending on your state of residence (e.g., California, Virginia, Colorado, Connecticut, or Utah), you may have the following rights regarding your candidate data:
You can request a disclosure of the specific pieces of information we have collected about you and the categories of third parties with whom we have shared it.
You may request that we update inaccurate or incomplete professional information or academic history in our records.
You can request the erasure of your candidate profile. Note that Yandaz may deny this request if we are legally obligated to retain the data for EEOC compliance or litigation holds.
You have the right to request that we limit our use of SPI (like your SSN or race) to only those purposes necessary to perform the recruitment services expected by an average applicant.
To protect your data, we must verify your identity before fulfilling a "Right to Know" or "Right to Delete" request. You may be asked to provide your full legal name, the email address used for your application, and a government-issued ID. We will match this information against our existing records. If you use an "Authorized Agent," we require written proof of their authority to act on your behalf.
In accordance with federal regulations (29 CFR Part 1602), Yandaz retains recruitment records for **3 years** for candidates not hired. This ensures we can respond to legal inquiries and fulfill audit requirements. If you are hired, your recruitment data will become part of your permanent personnel file and will be retained for the duration of your employment plus 7 years post-termination.
In certain U.S. jurisdictions (e.g., Illinois BIPA), the use of biometric identifiers requires specific disclosure. If a role requires biometric access control (e.g., fingerprint entry for a secure data center), a separate, explicit consent form will be provided prior to collection. Yandaz does not currently use biometric data for recruitment or candidate screening.
